All of the information communicated is circulated with respect for terms of the law of 21st June 2004 on confidence in the digital economy and conforms with the provisions of the laws of 29th July 1881 on freedom of the press, of 1st August 1986 and of 30th September 1986. The entire content of the site is governed by the Law which confers on the reader various rights and obligations. The editor of the site commits to respecting the editorial rules in force:

- to possess the right to circulate on his or her site the content proposed
- to do the utmost to verify the authentication of information brought to public attention
- to respect the rules of journalistic ethics in force
- to inform the reader of the editorial nature of the content proposed
- to authorise the reader to print all or part of the content proposed on the site for his or her strictly personal usage
- to respect the recommendations decreed by ANSM (Agence nationale de sécurité du médicament).

National Commission for Computer data and Liberties:
In accordance with deliberation N°2006-138 of 9th May 2006 determining the exemption from declaration of processing tasks carried out for the purposes of information or external communication (exemption n°7 – Official Journal n°128 of 3rd June 2006). The national Commission of computer data and liberties, given convention n°108 of the Council of Europe 28th January 1981 for the protection of individuals regarding the automatic processing of personal data; given directive 95/46/EC of the European parliament and of the Council on 24thth January 1978 relating to computers, files and liberties modified by law n° 2004-801 of 6th August 2004 relating to the protection of natural persons regarding the processing of personal data, and notably its article 24, II; given decree n° 2005-1309 of 20th October 2005 taken for the application of law n° 78-17 of 6th January 1978 relating to computers, files and liberties, modified by law n° 2004-801 of 6th August 2004; after having heard Mrs Isabelle Falque-Pierrotin, commissioner, in her report and Mrs Pascale Compagnie, commissioner of the Government, in her observations; formulate the following observations: processing carried out for the purposes of information or for external communication are routine tasks that do not appear likely to harm the private life of individuals within the framework of their legitimate usage. The Commission consequently considers that there is reason to apply the provisions of article 24.II of the law of 6th January 1978 modified and to exempt these processing tasks from any prior declaratory formality.
- Article 1: exempted from declaration are the processing tasks carried out for the purposes of information or for external communication comprising data on natural persons who fulfil the following conditions.
- Article 2: Purposes of the processing – Processing must have as its sole purpose the constitution and usage of an address file for purposes of information or for external communication related to the aim or to the activity pursued by the natural person or legal entity who implements the processing, to the exclusion of any commercial request. In the event that an online public communication service is used (internet site), a processing of connection data for purely statistical purposes may be carried out.
- Article 3: Processed data – Data processed for the implementation of purposes described in article 2 are: - identity: surname, forenames, address and telephone number (landline or mobile), fax number, e-mail address; professional life: work address, role or position, titles and distinctions; areas of interest, to the exclusion of those that bring to light, either directly or indirectly, racial or ethnic origins, political, philosophical or religious opinions or trade union affiliation of individuals, or which relate to the health or sex life of individuals (article 8 of the law of 6th January 1978 modified); connection data (date, time, IP address of the visitor’s computer, page consulted) for the sole statistical purposes of assessing the frequenting of the site. The data recorded may not be the subject of other processing tasks, nor of interconnections or of putting in touch with other applications. The data recorded may not be used for purposes of political, electoral or commercial canvassing.
- Article 4: Recipients of data – Permitted to be recipients of this data, are those persons authorised within the services whose mission is to ensure the circulation of information set out in article 3.
- Article 5: Information of persons concerned – The persons concerned are informed, at the moment of collection of their data, of the identity of the processing coordinator, of the purposes sought by the processing, of the obligatory or optional nature of responses to be given, of the potential consequences, in their case, of the lack of a response, of the recipients of the data, of their right to opposition, access and correction as well as the modalities for exercising their rights. In the event of any operation of information or external communication, the rights to access, correction and opposition must be reminded to the persons concerned. When the head of the online public communication service uses automated processes for the gathering of data that aims to access, by electronic transmission, information stored in the connection terminal equipment of the user or to register, by the same route, information in their connection terminal equipment (for example: cookies, Java applets, active X components or other mobile code), users are informed of the purpose of the usage of these processes and of the means available to them to oppose them.
- Article 6: Duration of keeping and updating of data – The data set out in article 3 are kept for the duration necessary for the implementing of the purposes defined in article 2 and are updated annually.
- Article 7: Security – The individual responsible for the processing is obliged to take all practical precautions to preserve the security of data and, especially, to prevent them from being distorted, damaged, or to prevent unauthorised third parties from having access to them. Access to the processing tasks is by means of an individual password that is regularly renewed or by any other measure that is at least equivalent.
- Article 8: Transmissions of data to third party countries in the European Union – Unable to claim the benefit of the exoneration are automated processing tasks comprising the transmission of personal data to third party countries in the European Union, including when this transmission is carried out for the purposes of subcontracting. These processing tasks are the subject of prior declaratory formalities with the CNIL (National Commission for Computer data and Liberties) within the conditions provided for by the law of 6th January 1978 modified.
- Article 9: Effects of the declaration exemption – Processing tasks fulfilling the conditions set out in articles 2 to 7 may be implemented immediately and without prior declaration to the CNIL. The declaration exemption does not exonerate the individual responsible for such processing tasks from any of his or her other obligations provided for by the texts applicable to the protection of personal data.

Restricted access

The services proposed by MD-FM are destined for two types of internet user:

    * physicians registered with the National Board of Physicians,
    * students in medicine.

The editor may not be held responsible for the content of information circulated by these third party sites proposed on the pages of radioifm.com.

Expert opinion
With the aim of broadening the field of awareness and satisfying the criteria of decree n°2006 relating to ongoing medical training, audio files circulated on the site contain opinions formulated by experts and/or members of learned societies of specialists or of general medicine. The editor does not guarantee in any way the exhaustive nature of information given during the transmission and would in no case be held responsible if such information were to be incorrect or incomplete. An expert opinon reflects solely the personal viewpoint of this specialist and may not in any case be considered as the opinion of the editor or as being the responsibility of the latter.

This site benefits from legal protection of data bases in accordance with the provisions of law 98-536 of 01/07/1998.

The internet user only acquires a right to use the information available (texts, logos, photographs, images ...) on the FréquenceM site that is limited to reading, archiving for personal and private use and acquires no right to reproduce in any form whatsoever, besides that of a single copy destined for a strictly personal usage.
